El-Rufai’s N1bn Fundamental Rights Suit Against ICPC Stalls Over Failure to Serve Respondents
A fundamental rights enforcement suit filed by former Kaduna State governor, Nasir El-Rufai, seeking N1 billion in damages against the Independent Corrupt Practices and Other Related Offences Commission (ICPC), has stalled due to the failure to properly serve court documents on the respondents.
The case, which was scheduled for hearing at the Federal High Court of Nigeria, could not proceed after the court was informed that the ICPC and other respondents had not been duly served with the originating processes required for the hearing.
Counsel representing El-Rufai told the court that the suit was filed to challenge alleged violations of the former governor’s fundamental human rights. The legal action seeks N1 billion in damages and other reliefs over what the applicant described as unlawful actions linked to investigations involving the anti-corruption agency.
However, during the proceedings, the presiding judge noted that without proof of service on the respondents, the court could not proceed with the matter. The judge subsequently adjourned the case to a later date to allow the applicant’s legal team sufficient time to properly serve the necessary documents.
Legal observers say the delay highlights the importance of due process and proper service of court processes before substantive hearings can begin.
The ICPC has yet to officially respond in court to the allegations raised in the suit.
