David Mark Seeks Court Reversal of INEC’s De-recognition of ADC Leadership
Former Senate President, David Mark, has approached the court to challenge the decision of the Independent National Electoral Commission (INEC) to de-recognize the leadership of the African Democratic Congress (ADC).
In a suit filed before a Federal High Court, Mark is seeking an order nullifying INEC’s action, which he described as unconstitutional, unlawful, and a violation of due process. He argues that the commission overstepped its statutory powers by interfering in the internal affairs of a political party.
The dispute stems from a prolonged leadership crisis within the ADC, which has led to the emergence of parallel factions, each claiming legitimacy. INEC’s de-recognition of one faction has further deepened tensions, prompting legal action from aggrieved stakeholders.
Mark, who is believed to be aligned with one of the affected factions, insists that only party members and established internal mechanisms should determine leadership disputes, not the electoral body. He urged the court to restore the status quo pending the resolution of the crisis.
Legal analysts say the case could set a significant precedent regarding the extent of INEC’s authority in party administration and internal disputes. Meanwhile, political observers warn that the lingering crisis may weaken the ADC’s cohesion ahead of future elections.
INEC has yet to issue an official response to the lawsuit, but sources indicate that the commission is prepared to defend its decision in court, citing its regulatory mandate over political parties.
