Electoral Act Breach: Retired Justice, SANs Knock Judges After NBA Outcry

A fresh storm has erupted within Nigeria’s legal community following allegations of Electoral Act breaches by some judicial officers handling election-related matters. The controversy intensified after the Nigerian Bar Association (NBA) raised concerns over perceived procedural violations and declining judicial standards in politically sensitive cases.

Retired Justice stakeholders and Senior Advocates of Nigeria (SANs) have now weighed in, strongly criticising what they describe as “unacceptable judicial inconsistencies” and “erosion of due process” in the handling of electoral disputes. They argue that recent rulings and courtroom practices risk undermining public confidence in the judiciary.

The retired justice forum warned that failure to address the alleged breaches could weaken democratic institutions and embolden future misconduct in election petition tribunals. They further urged the National Judicial Council to enforce stricter accountability measures.

Meanwhile, SANs insist that judges must remain strictly guided by the Electoral Act and constitutional provisions, stressing that any deviation threatens the credibility of Nigeria’s electoral justice system. Calls are growing for reforms to restore trust and ensure transparency in judicial conduct during elections.
